The ‘PLAYBOX’ service is a web game and is addressing MTN and Airtel Nigeria subscribers, where they can participate for a chance to win cash and exciting prizes via draw or skill.

Description

The service is designed to engage MTN and Airtel subscribers with General Knowledge and localized Trivia questions.

The subscribers can participate in the service by sending subscription requests (SMS) to the designated advertised Short Code the NCC approved short code for the Game.

Subscribers can also subscribe to the service and play via web by visiting the website.

Subscribers gather points through their daily subscription, by replying correctly to the trivia questions as well as by purchasing on-demand games. The gathered points correspond to chances for the draws.

The participation in the categories stated above will run through the Web platform created for the purpose of the service. By entering the service, a participant accepts the Terms and Conditions set below and agrees to be bound by them.

  1. 1. Territory

    1. The service will be valid in the territory known and recognized as The Federal Republic of Nigeria (hereafter referred to as “Nigeria”).
  1. 2. Game Target

    1. 2.1 The service is open to all Nigerians both home and abroad. Participants must be 18 years or older. A Participant hereby warrants and represents that he/she is:

      1. i. At least 18 years old and eligible to participate in the Game in the same manner as being eligible to enter valid contracts under Nigerian law.

      2. ii. Participating voluntarily

      3. iii. Have perused and have a clear understanding of the Terms and Conditions of the Game

      4. iv. Fully aware & accept that messages sent on the platforms in the course of participation in the Game shall only count for the purpose of this Game where same have been duly charged in accordance with this Terms and Conditions

      5. v. Fully aware & accept that any sums applied or expended in participating in the Game is non-refundable

    2. 2.2 The Organizer reserves the right to verify the eligibility of participants which will also include confirmation of details of participants as registered in their SIM registration process and their status as bona fide Nigerian citizens at all material times. Participants hereby agree that personal data supplied when participating in the service may be used by the Organizer to monitor participation in the service and to evaluate the service improvements.

  1. 3. Means of Participation

    1. 3.1. “PLAYBOX” service

      To participate, send ‘WIN’ and join the daily subscription for N50 (Fifty Naira) / day via SMS to the designated/advertised short code 13013 or via Web by visiting http://playbox.ng/. Upon every subscription request, users will perform a double opt-in process via a SAT push menu that will be provided to them with the following options:

      • Accept renewal - daily subscription at the cost of N50 (Fifty Naira) including all taxes

      • Accept One-off - daily game at the cost of N50 (Fifty Naira) including all taxes

      • Cancel - Request is canceled, and the user is discarded without any charge

    2. 4.2. Eligibility criteria for the Draws:

      To be eligible for the draws, a participant must have at least fifty (50) points either from subscription service or one-off games within the prize period. The more points, the higher the chances to win at the draws. The draws take place at the end of each above-mentioned period.

    3. 4.3. Eligibility criteria for skill-based daily prizes:

      In the initial phase each participant may consume the subscription or on-demand credit(s) to play the “Win” Trivia game. The instant prize of 10k can be won by any player that answered the questions correctly. When the participant plays the “PLAYBOX” Trivia game, with every question that he/she answers correctly is awarded with points that are converted to chances for the Draws.

    4. Each participant is eligible to win one (1) prize maximum from each prize category, meaning one (1) Instant Prize, one (1) draw prize, for each prize period.

    5. 4.5. Any participant may be contacted for any or all the prize categories stated above. If a participant is declared winner and is not resident in Nigeria, he shall provide details of his representative who will act for and on his behalf for the collection of the prize. The representative must present a Letter of Authorization, a valid means of identification (National I.D card, Driver’s License, International Passport or Certified Employment or University Student I.D Card) and any other information as may be required by the Organizer before prizes can be redeemed.

    6. 4.6. Prizes must be accepted as awarded, cannot be exchanged for other prizes or cash and may not be transferred or exchanged. Prizes will be delivered within one hundred eighty (180) days from the end of each draw period.

    7. 4.7. Any expense not explicitly indicated as part of the prize, including but not limited to insurance, travel expenses, accommodation, license fees or taxes, are the responsibility of the winner. In no event shall the Organizer be held liable for external fluctuations that might affect the economic value of the allocated prizes.

  1. 5. Games & Points Scheme

    1. 5.1.Every REGISTRATION SMS successfully received from the designated short-code 13013 indicates that a charge (inclusive of all taxes) has been deducted and subscribers are charged N50 (Fifty Naira) for the daily subscription service.
    2. 5.2. Upon getting subscribed, the subscriber is awarded with one (1) credit, allocated at one credit per day. Daily subscribers are also awarded with 20 points for each renewal in the daily subscription.

    3. 5.3. Users cannot participate in the daily service/one-off game without subscribing. When selecting the daily one-off game at a cost of N50 (Fifty Naira), participants are awarded with one (1) credit to play the game but are not eligible for auto-renewal. One-off users are also awarded with 20 points.

    4. 5.4. Subscribers to the service are eligible for auto-renewal. Service renewal is performed when the subscription period ends, and the user is charged again at the subscription cost via the same billing cycle.

    5. 5.5. Users of the service upon their confirmation of participation receive a Registration SMS that informs them of their participation to the service and the charge. Participants also receive a Welcome SMS which contains the unique access link that redirects them to the web portal of the game to start playing.

    6. 5.6. Each “PLAYBOX” Game round consists of a set of Trivia questions. Subscribers may reply via web, by tapping on the unique link served through SMS. If not consumed, the credit should remain active until the next subscription charge or on-demand purchase, when it will be replaced by a new one. Each PLAYBOX game round awards points based on the below scheme:

      • Every Question: 10 points

      • Wrong/invalid replies award 0 points

    7. 5.7. Daily subscribers may purchase unlimited Game rounds on-demand at a cost of N50 (Fifty Naira) each. The on-demand extra game purchase also awards twenty (20) points. If not consumed, the purchased credit should remain active until the next subscription charge, when it will be replaced by a new one.

    8. 5.8. At any time during the service period the participant can opt-out of the service by dialing the USSD code *447# or by sending the keyword STOP WIN to the designated short-code 13013.

    9. 5.9. For participants to be eligible to participate in the upcoming draw, they must have at least one billed interaction within the prize period.

  1. 6. Winner selection, notification, and prize forfeiture

      6.1. A winner would be selected during a draw every last day of the week throughout the period of the service.

      6.2. For every prize available in the prize period, one winner is selected. Additionally, 10 (ten) substitute winners are selected in the case that the winner cannot for any reasons be awarded with the prize.

      6.3. Every winner will be contacted by the Organizer on the mobile phone number he has used to participate in the service. The Organizer will attempt to contact a winner at least 3 times as designated by the NLRC Act, between the hours of 9am and 8pm.

      6.4. A winner will be required to provide proof of eligibility including but not limited to a National ID card, Driver’s License, International Passport, Certified Employment or University Student ID Card and sign a prize acceptance form (as may be requested by the Organizer) before prizes can be collected. If the winner fails to provide sufficient proof within a period of 48 hours requested by the Organizer, he/she is disqualified and forfeits the prize.

      6.5. Winners agree to the publication of their names and /or photographs in any media or promotional material produced by the Organizer. Such use does not entitle the winner to any further compensation.

  1. 7. Abuse and Disqualification

      7.1. Any Participant may be disqualified at any stage of the service, for any of the following reasons:

      1. Participants are not allowed to use machines that automatically send SMS messages or automate/facilitate the Registration process or any other alternative of sending SMS messages, other than the mobile phone. The Organizer has the right to disqualify any Participant under the suspicion of breaking this obligation;

      2. If the Participant ceases to be a Nigerian Citizen either on the date of a draw and/or on the date that the prize is to be presented;

      3. In the event that it is impossible to establish telephone communication with the prospective winner in accordance with clause 6.3 above;

      4. In the event that the winner refuses to be contacted during a live show and its name to be posted on TV, service’s website http://playbox.ng well as in SMS messages for testimonial purposes;

      5. In the event that the winner does not sign the declaration of acceptance of the Prize, irrespective of the reason(s) for such;

      6. In the event that the winner does not provide any proper identification document as required by these Terms and Conditions;

      7. In the event that the winner, for whatever reason(s), does not accept in full and without reservation the Terms and Conditions and his/her obligations which arise from the acceptance of such regulation, in respect of the allocation of the prize;

      8. In the event of incompatibility arising from the selected winner lacking legal capacity (e.g. the fact that the selected winner is related directly or indirectly with the Organizer or is under-aged) in accordance with that set forth in the present Terms and Conditions;

      9. In the event that the registered holder of the winning MSISDN has not been charged for any SMS sent during the period of the service. The Winner shall forfeit the Prize and the Prize shall be awarded to a Substitute generated through the draw;

      10. The failure to comply with or observe any of the Terms and Conditions set out herein;

      11. In the event that the winner is seen or found to have participated in the service by way of fraud, deceit or in any manner which contravenes the spirit and intent of the service, the terms and conditions herewith or in a manner prejudicial and/or unfair to other Participants;

      12. Employees of the Organizer and any company directly collaborating with the Organizer for the purposes of executing the service, their spouses, direct members of their families or households, relatives of direct kinship or any other person in a position to benefit illegitimately from unpublished or privileged information connected to service, and all persons in a position to interfere with the operation of the service (legitimately or illegitimately) are disqualified from participating in this service.

  1. 8. General Conditions

      8.1. If, for any reason, a Participant decides to change his mobile phone number during a prize period, the accumulated points shall not be transferred to the new number but shall remain with the initial MSISDN. Entries cannot be transferred from one phone number to another.

      8.2. The service and features within the service may also be protected by intellectual property rights belonging to the Organizer or to their licensors. No license is granted to Participants in respect of any such rights, except to the extent required for Participants personal use of the service in accordance with these terms and conditions. “PLAYBOX” and any other “PLAYBOX” product or Service name are owned by the Organizer and Participants shall not be entitled to reproduce such marks (other than to the extent required for Participants personal use of the Service) without the Organizer’s prior written consent.

      8.3. Some aspects of the service may be supplied to the Organizer by third parties and while the Organizer shall exercise all due care to ensure that such third parties comply with all applicable rules, the Organizer make no promises, and do not accept any liability, either express or implied as to the service, including but not limited to its accuracy, relevance or quality, except as stated in these Terms and Conditions.

      8.4. Any participation in the service is entirely at the risk of the Participant and in no event shall the Organizer be liable for any direct, indirect, incidental, or consequential damages including without limitation loss of income, data or other information as a result of the use of or inability to use the service.

      8.5. Any deviation from the rules and/or attempt to manipulate the outcome of the service or the entitlement to a Prize will result in an automatic disqualification of that Participant. The Organizer shall be entitled to effect the disqualification without reference or recourse to the Participant(s) carrying out the said manipulation.

      8.6. The Organizer reserves the right to with prior notification to the NLRC modify, supplement or terminate all or part of this service at any time.

      8.7. The Organizer reserves the right to replace the advertised prizes with prizes of the same at their sole discretion.

      8.8. Prizes are non-transferable in whole or in part and must be taken as stated.

      8.9. A participant is entitled to receive only ONE instant prize in a month, regardless of whether the participant wins multiple times or wins with multiple unique MSISDNs.

      8.10. A winner will receive payment only when he/she has uploaded his/her necessary details(account details) unto the website.

      8.11. The Organizer accepts no responsibility for any incorrect or incomplete registration details that Participants may supply as part of the registration for the service.

      8.12. The Organizer accepts no responsibility for undelivered, lost or delayed SMS or entries nor for any network errors for which there may be delays during peak time. Proof of sending SMS by Participants is not proof of receipt by the Organizer.

      8.13. The Organizer gives no warranty or guarantee whatsoever in relation to any Prize and Participants hereby release and hold the Organizer and their agents harmless from any and all liability, injury, loss or damage of any kind, so far as it is permitted by law, arising from the participation or Participant’s acceptance of use or use of any Prize.

      8.14. The Organizer reserves the right to disqualify any entry at its sole discretion.

  1. 9. Organizer’s responsibilities

      9.1. Organizer’s responsibility is strictly limited in giving the Prizes. The Organizer cannot be held responsible for any delay or impossibility of sending or receiving SMS messages because of a technical problem. All the SMS messages will be considered received by the Organizer when they are registered in the service’s IT system and not when they are sent by the Participant. All the REGISTRATION SMS messages will be considered received by the Participant at the moment they were sent from the service IT system. Participants recognize and accept that the journal of the informatics system of the service IT System is the proof of the date, hour, minute and second of their receiving/ sending each SMS message.

      9.2. Except for force majeure incidents such as disruptions in power supply, the Organizer will procure the technical equipment and the needed software for the service, without taking responsibility for any technical or network failures. Any claim of a Participant will be resolved by the Organizer, if it is well-founded, assuring the equality of chances for the Participants and repairing the prejudice, if possible.

  1. 10. Personal Data Protection

      10.1. By participating in the service, the Participants expressly agree that personal data which they supply shall be processed by the Organizer for the purposes of executing the service and also for the purpose of publicizing the service and the Organizer. It is hereby specified that the Organizer guarantees that publicity, entailing the sharing with third parties of personal data supplied as a result of participation in the service, (including through television, the press, leaflets and other means and formats of communication) shall be made only with respect to the winners of the Prizes and will only indicate the given names and surnames of the winners, the location of their place of residence, their images and voices (contained in photographic records, audio, video and other types of records, made with the purposes of publicity connected to the service). The winning Participants give, through their participation in the service, express consent for the use of this data informants herein defined. Following the termination of the service, the personal data will be destroyed.

      10.2. In accordance with local laws and regulations, the Organizer respects the privacy of Participants of this service by which it is committed to the use of technology in a transparent form and in strict observance of the rights, freedom and guarantees of the citizens and by the reservation of the intimacy of their private and family life. The personal data collected within the scope of this service will be treated as private and confidential. It shall not be disclosed to other individuals or organizations, except in the event of legislation to the contrary or where such is authorized by the Participants themselves. The data will be stored on servers with access controlled on a needto-know basis and limited by passwords.

  1. 11. Amendments to the Terms and Conditions

      11.1. The Organizer reserve the right to alter, suspend or cancel this service and its respective Terms and Conditions, without prior notice and upon prior authorization issued by the appropriate authorities, with the new rules coming into force upon disclosure by publication on the website http://playbox.ng

      11.2. No alteration may have retrospective effects, whereby all Participants registered up to the moment of the introduction of the alteration shall have equal rights. Each alteration, including the extension or reduction of the Duration Period of the service, shall be included in and form an integral part of these Terms and Conditions and shall be introduced through the addition of an annex, which shall be applicable from the date of its publication on the website http://playbox.ng

      11.3. No claim in respect of any alteration of the present Terms and Conditions is enforceable against the Organizer following the moment at which this alteration becomes available for online consultation on the website http://playbox.ng

      11.4. In the event that the service is suspended prior to the period designated for its conclusion, the Organizer shall award the Prizes corresponding to the winners selected up to the date of the suspension of the service, in accordance with the present Terms and Conditions.

  1. 12. Governing law and Jurisdiction

      12.1. Any dispute arising from or connected to this service shall be subject to the exclusive jurisdiction of the competent Nigerian authorities and in accordance with Nigerian law.
